Standing Counsel 11 ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 06-08-2024 Heard Mr. Maheshwar Prasad, learned counsel appearing on behalf of the petitioner and learned Standing Counsel 11, appearing on behalf of the State.
2. The petitioner in paragraph no. 1 of the present writ petition has sought for inter alia following relief(s), which is reproduced hereinafter:
"That this is an application praying in for issuance of appropriate writ/writs, order/orders in nature of mandamus to
Patna High Court CWJC No.11730 of 2024(2) dt.06-08-2024 2/3 the respondents to pay of benefit in the scale of pay of Rs. 4000/- to Rs. 6000/- with effect from the date of appointment i.e. 20.02.2006 in the light of C.W.J.C. No. 15309/2021 Srimati Jayanti Devi and Others Versus The State of Bihar and others order passed on 25.11.2021.
Further the pursuance of order dated 25.11.2021 passed by the Hon'ble High Court Patna and pursuance of order Department vide office order 944 dated 23.05.2022 Department had allowed to benefit of higher pay scale to all employees in the instant case, Contained as Annexure-P/3 of this application. And for further prays in view of the Clause 4 c (i) Bihar State Litigation Policy 2011, the petitioner is entitled for the same similar reliefs and other relief or reliefs be granted to the petitioner for which he is found legally entitled to in the facts and circumstances of the Case."

Learned counsel appearing on behalf of the petitioner seeks to withdraw the present writ petition with a liberty to file a detailed representation before the Additional Chief Secretary, Prohibition Excise and Registration Department (Excise) (Respondent No.2) for redressal of his grievance, as prayed for in the present writ petition.
4. Considering the aforesaid fact and relief(s) sought for in the paragraph no. 1 of the writ petition, the petitioner, if so desire, may file a detailed representation before the Additional Chief Secretary, Prohibition Excise and Registration Department (Excise) (Respondent No.2) for considering his relief(s), as claimed in the present writ petition and the Additional Chief Secretary, Prohibition Excise and Registration Department (Excise) (Respondent No.2) is directed to dispose of the representation filed by the petitioner, expeditiously, in accordance with law.
