2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 148 , 341 , 323 , 324, 448 , 308 , 504 and 506 of IPC . 3 . As per the prosecution case , informant namely Bodhan Mali alleged that on 28.07.2023 at about 3:00 PM, all the F.I.R. named accused persons including these petitioners armed with lathi, danda , tangi and farsa abused and assaulted informant and others due to which they sustained injuries and also threatened with dire consequences.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.50378 of 2025(2) dt.17-09-2025 2/2 petitioners are innocent and have falsely been implicated in this case due to land dispute . Allegation of abuse and assault is general and omnibus against these petitioners. No specific allegation of overt act is alleged against them. Police after thorough investigation submitted final form against these petitioners. Petitioners claim clean antecedent. 5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid facts, clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate - 1st Class Jamui in Simultalla P.S. Case No. 101 of 2023 subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
