Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends her arrest in connection with Pirbahore P.S. Case No. 103 of 2020 registered for offence punishable under sections 302 and 120B read with 34 of the Indian Penal Code and section 27 of the Arms Act. As per allegation, when the informant came out of his house on hearing hue and cry, the persons assembled there apprised that someone has committed murder of his father by opening fire shot. Patna High Court CR. MISC. No.57238 of 2021(3) dt.06-09-2022 2/3 occurrence. The injured was brought to P.M.C.H. where he was declared dead. It has further been alleged that the alleged occurrence had taken place due to previous land dispute between the informant and co-accused Brijendra Kumar Sinha, Arvind, Chandan Kumar and the present petitioner. One day prior to the occurrence, co-accused Sujeet Mehta, Jayanti Devi, Suraj Sah, and Chhotu Sah had threatened to kill the father of the informant.

The learned counsel for the petitioner has submitted that the petitioner is a lady and during investigation, nothing emerged against the petitioner as well as against other accused persons, as such, the police submitted final form. He has submitted further that on similar allegation, co-accused Chandan Kumar @ Chandan and Arvind Kumar @ Arvind, the husband of the petitioner, have been granted anticipatory bail in Criminal Miscellaneous No. 39042/2020.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of her arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
