In this case, the petitioner is seeking anticipatory bail in connection with Garkha P.S. Case No.185 of 2015 (G.R. No.3996 of 2015), registered for the offence punishable under Section 366A/34 of the Indian Penal Code.
As per the F.I.R. at about 4:00 am. the daughter of the informant had gone for natural call, but did not return. On inquiry, one Gupal Rai informed that his daughter was going along with Dhupa Rai in a Bolero car. Allegation has been against the petitioner that she had told the informant that Dhupa Rai had taken his daughter and within 10 to 15 days she will call the girl.
Patna High Court Cr.Misc. No.41122 of 2017 (2) dt.04-10-2017 2/2 Learned counsel for the petitioner submits that there is no allegation against the present petitioner to have extended the assistance with respect to taking away the girl. Looking to the facts and circumstance of the case, let the petitioner, namely, Lila Devi, be released on anticipatory bail in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-V, Saran at Chapra, in connection with Garkha P.S. Case No.185 of 2015 (G.R. No.3996 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
