JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-06-2023 Though the present writ petition has been filed for grant of the benefits of second A.C.P. with effect from 09.08.1999, to the petitioner, who has superannuated as Assistant Statistical Officer w.e.f. 31.12.2007, while working in the office of District Statistics Office, Munger, however, the learned counsel for the respondent-State has referred to the counter affidavit filed in the present case to submit that the petitioner has already been granted second A.C.P. vide office order dated 16.07.2018 with effect from 09.08.1999, nonetheless, it is submitted by the
Patna High Court CWJC No.22873 of 2013(2) dt.22-06-2023 2/2 learned counsel for the petitioner that the actual monetary benefits have not been paid to the petitioner till date.
Having regard to the facts and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the Director, Statistics and Evaluation, Planning Department, Government of Bihar, Patna as also the District Statistical Officer, Munger to grant monetary benefits emanating out of the aforesaid order dated 16.07.2018 within a period of four weeks from today, failing which they shall not draw their salary.
The writ petition stands disposed off on the aforesaid terms.
