2. The petitioner seeks bail in connection with Athmalgola P.S. Case No. 57 of 2026, registered for the offences under Sections 191(2), 191(3), 190 and 109(1) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.

3. The allegation is that the informant was proceeding to answer a call of nature when firing broke out between two groups. He was a stranger to the dispute but sustained a gunshot injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. The petitioner has been in custody since 23.03.2026 and has no criminal antecedents.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. The allegation of firing is against five persons and it has not been specified whose shot hit the victim. The petitioner is 64 years of age, has no criminal antecedents, and has been in custody since 23.03.2026. Thus, this Court is inclined to grant bail to the petitioner.

7. Let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Barh, DistrictPatna, or the concerned Court, in connection with Athmalgola P.S. Case No. 57 of 2026.

8. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application. Such observations shall not be construed as an expression on the merits of the case and shall not influence the trial or any other proceedings in any manner.
