2. Learned counsel for the appellant has submitted that only one day time was provided to the prosecution for examination of the informant and remaining two witnesses and thereafter, the evidence of the prosecution was closed.
3. Charges were framed in the year, 2010 and thereafter, the opportunity was given to the prosecution for producing the witnesses but the prosecution could not be able to produce all the prosecution witnesses for recording of their evidence.
4. Be that as it may, a last opportunity of two days is being provided to the prosecution for adducing evidence, had the stage of the trial not been changed. In any case, no further
Patna High Court CR. APP (SJ) No.4110 of 2018(10) dt.25-06-2024 2/2 opportunity shall be provided to the prosecution.
5. With the aforesaid observation(s), this Memo of Appeal is disposed of.
