Heard learned counsel for the petitioner and learned APP for the State.

The learned counsel for the petitioner submits that petitioner was granted the privilege of anticipatory bail by an order dated 8-5-2024 in Cr. Misc No. 70269 of 2023, but then from perusal of the order dated 8-5-2024, it would manifest that the same records:- "Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. ......../- (Rupees ......) with two sureties of the like amount each to the satisfaction of the learned ------ in connection with ......., subject

Patna High Court CR. MISC. No.49572 of 2025(3) dt.25-07-2025 2/2 to the conditions laid down under Section 438(2) of the Cr.P.C." 3.

On query, it transpired that inadvertently the aforesaid order on 8-5-2024 in Cr. Misc No. 70269 of 2023 was uploaded, instead of the signed order dated 8-5-2024 in Cr. Misc No. 70269 of 2023.

The Court has perused the signed order dated 8-52024 in Cr. Misc No. 70269 of 2023 in which amount of bail bonds, name of the learned trial court where the case is pending and the P.S. case number is recorded, but inadvertently instead of the signed order dated 8-5-2024, aforesaid order was uploaded, as such the Court directs that the signed order dated 8-5-2024 in Cr. Misc No. 70269 of 2023 is uploaded in letter and spirit and the existing uploaded order be deleted. 5.

It is made clear that if the petitioner surrenders on or before 11-8-2025, he shall be released on anticipatory bail on the same terms and conditions as contained in order dated 8-52024 in Cr. Misc No. 70269 of 2023. 6.

The modification application is allowed.
