10-01-2017 Heard Sri Shakti Suman Kumar, learned counsel for the petitioner.

The present petition has been filed with a prayer to restore Civil Revision No. 802 of 2009, which stood dismissed on 21-05-2009, due to non-prosecution.

The civil revision was filed against an order of appointment of Pleader Commissioner in a suit, which was filed long back in the year 1999, vide Title Suit No. 58 of 1999. Learned counsel for petitioners tried to persuade the Court the reason for non-appearance.

However, after hearing learned counsel for petitioners and examining the matter, the Court is not persuaded with the ground taken in the petition for restoration.
