JUSTICE PARTHA SARTHY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 25-09-2023 The petitioner is concerned with the direction issued, which was to remove an encroachment. Even the parties who were alleged to be the encroachers were not impleaded. Despite that, this Court directed the Circle Officer, Dinara, DistrictRohtas, to treat the complaint at Annexure-1 series as a complaint under the Bihar Public Land Encroachment Act, 1956, and initiate proceedings. It is admitted that the proceedings were initiated, and encroachment was removed by demolishing the building.

2. However, it is stated that the debris is still remaining there. It is for the District administration to utilize the public land appropriately and we do not find any contempt as such from the direction issued.

3. The present MJC stands closed.
