2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 452, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act, registered in connection with Lodipur P.S.Case No. 96/20.
3. Sulendra Yadav (deceased) lodged his fardbayan, stating therein that in the night of 07.05.2020 while he was sleeping in his room, someone came and fired at him. On shouting of the deceased, his wife Komal Devi (co-accused) came and she called the father and mother of Sulendra Yadav. They brought him to the hospital wherefrom he was referred to
Patna High Court CR. MISC. No.48980 of 2025(5) dt.19-12-2025 2/3 JLNMCH Bhagalpur. On 15.05.2020, after a surgery, a bullet was taken out from the body of the deceased. The deceased died on 08.09.2020.
4. During investigation, the statement of the father of the deceased was recorded in which the father of the deceased stated that Komal Devi (wife of the deceased) had illicit relationship with the petitioner.
5. The learned counsel for the petitioner has submitted that the petitioner had no relationship with the wife of the deceased. As a matter of fact, the father of the deceased himself had illicit relationship with her for which Komal Devi had lodged a case being Lodipur P.S.Case No. 231/2020 against her father-in-law Dinesh Yadav. The learned counsel has submitted further that Komal Devi has been granted bail by a coordinate Bench of this Court. It is further submitted that the deceased was a person of criminal background and had twelve criminal cases were pending against him.
6. On the other hand, the learned APP for the State has opposed the prayer for bail.
7. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the
Patna High Court CR. MISC. No.48980 of 2025(5) dt.19-12-2025 3/3 like amount each to the satisfaction of learned SDJM, Bhagalpur in connection with Lodipur P.S.Case No. 96/20, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
