2. The present petition has been preferred for the following relief/s:

(i) to issue an appropriate writ preferably in the nature of Mandamus, commanding upon

Patna High Court CWJC No.10205 of 2026(2) dt.20-07-2026 2/3 the Respondent authorities to remove illegal encroachment over the land of the petitioner appertaining to Khata No. 857, Plot No. 3359, area 05 decimal situated in MauzaTarar, block-Daudnagar, DistrictAurangabad;

(ii) to issue an appropriate writ preferably in the nature of Mandamus commanding upon the Respondent authorities particularly the Circle Officer, Daudnagar, DistrictAurangabad to take appropriate legal step for removal of encroachment over the aforesaid land of petitioner by the Private Respondent (Respondents 2nd set) at the earliest;

(iii) to grant any other relief/reliefs for which the petitioner may be found entitled to, in the peculiar facts and circumstances of the case.

3. Learned counsel for the petitioner submits that during the pendency of the petition, a petition has been preferred by respondent nos. 09 and 10 before the Divisional

Patna High Court CWJC No.10205 of 2026(2) dt.20-07-2026 3/3 Commissioner, Magadh Division, Gayaji in BLDR Appeal No. 53 of 2023-27 (Md. Hasmat Alam & Anr. vs. Sabra Khatoon & Ors. in which they have received the notice and intend to respondent to it.

4. In that background, permission is granted to withdraw the writ petition with liberty to agitate it as and when required.

5. Learned State counsel has no objection.

6. Granting said liberty, the writ petition is disposed of.
