The petitioner seeks bail in connection with Sahebganj P.S. case no. 219 of 2019 instituted for the offence under Section(s) 30(a), 36, 38(ii) of the Bihar Prohibition & Excise Act, 2016 & sections 272 and 273 of the IPC. Learned counsel for petitioner has submitted that there is no recovery of any foreign liquor from conscious possession of this petitioner.

It is mentioned in the seizure list that seizure has been made in front of house of Ajay Singh. The petitioner has been arrested merely on suspicion levelling allegation that they were trying on run away on seeing the police party. The other co-accused of this case has already been

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act), Muzaffarpur in connection with Sahebganj P.S. case no. 219 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
