Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Hajipur Town P.S. Case No. 191 of 2019, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, this petitioner along with co-accused Jitu committed murder of the husband of informant. It is submitted on behalf of the petitioner that petitioner is nowhere related with the informant. Petitioner is 30 years old and the informant is 20 years old and she could not be

No.4349 of 2021(5) dt.06-08-2021 2/2 the daughter of petitioner and petitioner is not the father of informant and he has falsely been implicated in this case merely on suspicion. Petitioner is in custody since 27.08.2020. Learned APP however, vehemently opposed the prayer for bail and submitted that this is a case of honour killing and petitioner who is alleged to be the father of informant has committed murder of informant's husband.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
