27-03-2019 Heard Sri Sidharth Harsh, learned counsel for the petitioner and Sri Shailendra Kumar-1, learned Addl. Public Prosecutor.
The sole petitioner, apprehending his arrest in Paliganj P.S. Case No. 262 of 2018 registered for offence under Sections 420, 406, 354(A), 323, 504/34 of the Indian Penal Code, has prayed for grant of bail in the event of his arrest or surrender.
Earlier, case diary was called for and on last date, it was handed over to Sri Shailendra Kumar, learned Addl. Public Prosecutor to examine as to whether the allegation made in the F.I.R. has been corroborated by the telephone call detail or not. On examination of the case diary, he submits that there is no such material on record.

No.67063 of 2018(6) dt.27-03-2019 2/2 Learned counsel for the petitioner, by way of referring to Annexure-2 of the petition, submits that from the petitioner's side, an F.I.R. was lodged and as a counter blast, the present F.I.R. was lodged by making unsustainable allegation. Besides hearing learned counsel for the parties, I have also examined the material on record, particularly the fact disclosed in the case diary as well as the fact that a case was instituted from the petitioner's side also.
In view of nature of accusation and the fact that there was case and counter case in between the parties, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely, Sunny Kumar @ Sunny Raj be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Danapur, Patna in connection with Paliganj P.S. Case No. 262 of 2018, G.R. No. 2588 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. (Rakesh Kumar, J.) anay U T
