The petitioner has superannuated way back in 2008. After retirement as Professor, he worked as Pro-Vice Chancellor of Veer Kunwar Singh University, Ara from 26.06.2009 to 15.06.2009 and thereafter he worked as Pro-Vice Chancellor in KSDS University.

The petitioner has approached this Court raising the grievance as to payment of arrears of salary and difference of arrears of salary as well as payment of Provident Fund and

Learned counsel for the petitioner admits that during the pendency of the writ application, the claim of arrears of salary and difference of salary have been settled. The grievance now unaddressed is Provident Fund and Earned Leave. Learned counsel for the petitioner submits that his claim as to Provident Fund and Earned Leave is reletable to Veer Kunwar Singh University as well as KSDS University. Since the petitioner has superannuated way back in 2008, the Court grants liberty to the petitioner to represent the Vice-Chancellor of Veer Kunwar Singh University and the KSDS University along with a copy of this order and on filing of such representation, the Vice-Chancellor of Veer Kunwar Singh University and the KSDS University shall pass appropriate order with regard to entitlement of the petitioner as to Provident Fund and Earned Leave.

The Vice-Chancellor of respective University are not only under obligation to decide the claim of the petitioner for payment of Provident Fund and Earned Leave, but they are also under obligation to ensure that the consequential monetary benefits must reach the petitioner within a maximum period of 60 days from the date of filing of such representation.
