JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Nanpur P.S. Case No. 46 of 2018, registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Sections 30(a) and 37(b) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 205.950 litres of liquor from the Math and the police on information found that one Sanjeev Thakur had stored the liquor and on raid police arrested two persons, who disclosed the name of the petitioner. Submission of learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against him and he has no criminal antecedent and further other co-accused in whose confessional statement name of petitioner has come has been granted privilege of anticipatory

Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District JudgeII-cum-Special Judge, Excise Act, Sitamarhi, in connection with Nanpur P.S.Case No. 46 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
