The petitioner seeks bail in Guthani P.S. Case No. 216 of 2018, instituted for the offence under Section(s)420, 413, 414, 429, 120(B) of the IPC, Sections 11(A), (D), (E), (F) of Prevention of Cruelty to Animal Act, 1960. It is alleged in the written report that informant during course of patrolling duty reached in village Deoria and saw one person tried to escape from the cabin of the truck. He was apprehended by the Police. He disclosed his name as Ekbal. He disclosed the name of driver as Taufique Ahmad (petitioner). On search of the vehicle, 14 oxen were recovered. Out of them, 13 were found to be dead and one was injured. Counsel for the petitioner submits that petitioner was
Patna High Court CR. MISC. No.44288 of 2019(2) dt.22-07-2019 2/2 driver of the vehicle. The animals were purchased and were taken to the destination, the local Police seized the vehicle. Petitioner is in custody since 7.5.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Guthani P.S. Case No. 216 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
