JUSTICE SATYAVRAT VERMA ORAL ORDER 07-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Sahebganj P.S. Cas No. 371 of 2021, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 08.08.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case and allegation is of recovery of 2457.320 litres of liquor from a school.

The learned counsel for the petitioner submits that the petitioner was not apprehended at the place of occurrence and his name was disclosed by the villagers has alleged that he had

Learned A.P.P. opposes the bail application.

Considering the fact that petitioner is in custody since 08.08.2021, he is a person with clean antecedent, charge-sheet has been submitted, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.2,000/- (Two Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Sahebganj P.S. Cas No. 371 of 2021.

The application stands allowed.
