JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 17-10-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners are seeking anticipatory bail in connection with Fatuha P.S. Case No.216 of 2017 registered for offences punishable under Sections 384, 385, 448, 454/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that a bare perusal of the FIR would show that it is a case of false implication because of a land dispute. The petitioners have got no criminal history. Earlier one of the petitioners had moved this Court in CWJC No.11399 of 2017 in which he had complained about encroachment on the road.

Patna High Court Cr.Misc. No.50645 of 2017 (2) dt.17-10-2017 On the other hand, learned APP for the State opposed the prayer for anticipatory bail.

In the facts and circumstances, in case of arrest or surrender of the petitioners within a period of four weeks from today, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Patna City in connection with Fatuha P.S. Case No.216 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
