The petitioner seeks bail in Harin Mar P.S. Case No. 3 of 2019 corresponding to SC No. 215 of 2019, registered for the offence punishable under Sections 304(B), 201 and 34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.
As per the prosecution case, petitioner along with other accused persons committed murder of informant's granddaughter by pressing her neck due to non-fulfillment of demand of dowry and concealed her dead-body. Petitioner is husband of the deceased.
It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence. No such
Patna High Court CR. MISC. No.56486 of 2021(2) dt.07-12-2021 2/2 occurrence has ever taken place and there was no demand of dowry by the petitioner. There is general and omnibus allegation. It is further submitted that six prosecution witnesses have already been examined. Petitioner is in custody since 25.03.2019 having no criminal antecedent.
Learned APP however, vehemently opposed the prayer for bail.
Considering the facts aforesaid, nature of allegation, the fact that petitioner is husband of the deceased and the progress of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected. However, trial court is directed to conclude the trial preferably within a period of nine months.
