JUSTICE ARUN KUMAR ORAL ORDER 17-10-2017 Heard learned Counsel for the petitioners and the State. Petitioners apprehend arrest in connection with Daudpur PS Case No. 159 of 2017 registered under Sections 341, 323, 324, 354, 354A, 379, 34 of the IPC.

The allegation in brief is that petitioner no. 1 in day hour entered into the house of the informant and tried to outrage modesty of his daughter.

Learned Counsel for the petitioner submits that the present case was lodged latter on as a counter case to the earlier case instituted by the petitioners' side in which the petitioner No. 1 was badly assaulted by knife and he received serious injury in the abdomen by the son of the informant of the present case and so in this background this false case was lodged. The petitioners have got no criminal antecedent.

Patna High Court Cr.Misc. No.49949 of 2017 (2) dt.17-10-2017 Having considered the said facts and circumstances, the petitioners, namely, Afroz Hussain @ Afroj Miyan and Afjal Miyan in the event of their arrest or surrender before the court below within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri R.M.Tiwari, Judicial Magistrate, lst Class, Saran in connection with Daudpur PS Case No. 159 of 2017 subject to conditions as laid down under Section 438(2) Cr.P.C..
