The petitioner is in judicial custody in connection with Benipatti P.S. Case No. 125 of 2021 corresponding to S.T. No. 339/2021 for the offence punishable under sections 304(B), 302 and 34 of IPC. lodged on 14.6.2021 by the informant, Jitendra Kumar Yadav.

As per the prosecution story, the petitioner is the husband of the deceased lady. The brother of the deceased lady is the informant and has alleged in the FIR that her sister was married one and half year ago with the petitioner but the in-laws were demanding Rs.50,000/- which the informant's family were unable to pay. It is alleged that on 14.06.2021, he was informed by one of his friend who was resident of the same village that

Patna High Court CR. MISC. No. 48781 of 2023(3) dt.01-09-2023 2/2 his sister has been killed by the petitioner and his family members. He reached the place, found the information true and then lodged the FIR.

Earlier the bail application of the petitioner was heard and rejected vide order dated 25.04.2022 in Cr. Misc. No. 71745 on 2021.

Again, a fresh application has been preferred whereafter a report was called for, which has since been received vide Letter no. 271/2023 dated 02.08.2023 according to which six witnesses have been examined and now only I.O. and Doctor are to be examined.

In that view of the matter and considering the allegations, it would be appropriate that the trial Court conclude the trial within a period of six months from today. The bail application stands rejected.
