On account of unauthorized absence resulting in closure of the center in question petitioner's selection as Anganbari Sevika for center no. 16 has been cancelled. Admitting to her absence, counsel for the petitioner submits that prior to absence, petitioner had submitted application for leave. In support of such contention, leave application has been brought on record by Annexure 4. The same is purported to have been submitted on 01.03.2012 for seeking leave for 02.03.2012. It is submitted before Mukhiya.
Patna High Court CWJC No.11212 of 2013(2) dt.19-11-2019 2/2 On specific query being made that Mukhiya is the competent authority to grant leave, counsel for the petitioner fairly submits that Mukhiya was not the competent authority but goes on to submit that intimation was also sent to the Child Development Project Officer on the same day. Document in support of such communication does not bear any signature and prima facie is unreliable.
The orders of the District Programme Officer, Supaul, District Magistrate, Supaul and Divisional Commissioner, Kosi Division affirming cancellation of the petitioner do not require any interference.
Writ petition is dismissed.
