The petitioner is apprehending his arrest in connection with Baikunthpur P.S. Case No. 53 of 2021 pending in the Court of learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise, Gopalganj in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 30(a) and 41 of the Bihar Prohibition & Excise (Amendment) Act, 2018.

It is a case of recovery of about 232.740 liters of English wine from the house of this petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Learned APP appearing for the State has opposed the

Patna High Court CR. MISC. No.57969 of 2021(2) dt.25-04-2022 2/2 prayer for anticipatory bail.

In view of the fact that the said English wine was recovered from the house of this petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected.

However, petitioner is directed to surrender before the court below and pray for regular bail.
