JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-07-2019 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Ahiyapur P.S. Case No. 396 of 2018 registered under Sections 406 and 420 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is ready to pay Rs.1,25,000/-, which is received by him from the account of informant-opposite party no.2, in two installments.

Learned counsel for the informant-opposite party no.2 submits that informant-opposite party no. 2 has no objection in allowing the pre-arrest bail of the petitioner, if

Patna High Court CR. MISC. No.68234 of 2018(5) dt.15-07-2019 2/2 petitioner pay the aforesaid amount of Rs.1,25,000/- to informant-opposite party no.2 in two installments. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 396 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C. It is made clear that the bail bonds of the petitioner will be accepted on showing receipt of Rs.

75,000/- at the time of furnishing the bail bonds and remaining amount of Rs.50,000/- will be paid within two months from today. If the petitioner fails to pay Rs.50,000/- within aforesaid two months, the court below would be at liberty to cancel the bail bonds of the petitioner.
