2. In this case, the petitioner is seeking regular bail in connection with Beldour P.S. Case No. 253 of 2022, registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per allegation, on a secret information, the informant along with other police party reached the place of occurrence. Seeing the police party, the accused persons including the petitioner fled away, after throwing their Cartoon. On search, 104.67 liters of illicit foreign liquor was recovered from the seized Cartoon.

4. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.49989 of 2024(2) dt.24-07-2024 2/2 that the petitioner is innocent and has falsely been implicated in this case. He is a person of clean antecedent. Nothing has been recovered from his conscious possession. He is under custody since 02.04.2024.

Considering the above-mentioned facts and circumstances as well as clean antecedent, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-II, Khagaria in connection with Beldour P.S. Case No. 253 of 2022, subject to the following condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
