JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-10-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Sadar Hajipur P.S. Case No. 356 of 2016 registered for the offence punishable under sections 307/34 of the Indian Penal Code and section 27 of the Arms Act.

Learned counsel appearing for the petitioner submits that the parties are agnates. Informant is a litigant person as against him there are several cases lodged by other residents of the locality. Informant's brother sustained injury for some other reason at some other place and taking advantage of the situation petitioner has been dragged in this case. Co-accused namely, Navin Kumar Singh @ Navin Singh has has been granted bail by this Court vide order dated 28.03.2017 passed in Cr. Misc. No. 14021 of 2017.

Patna High Court Cr.Misc. No.40166 of 2017(3) dt.09-10-2017 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is direction allegation of firing against this petitioner which is supported by injury. Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
