2. The present petition has been preferred for the following relief(s):

"for issuance of a writ / order / directions to the respondents to make payment to the petitioners for approx 52 dec. of land of Plot no. 363 appertaining to Khata no. 219 of Village Nathupur, P.S. Phulwari, P.S. no. 109, Dist Patna which has been acquired in Land Acquisition case no. 62/201213 by respondents for the purpose of extending the National High Way 30 and 84 (Patna Buxar) forthwith so that petitioner may not suffer any loss and injury and perform the marriage of their

3. A counter-affidavit of respondent nos. 2, 4 and 5 is on record and paragraph-9 shows that if the petitioners have any grievance, can move before the Arbitrator/appropriate authority for the redressal of his grievance.

4. Learned counsel for the petitioners submit that in eight weeks, they shall be approaching the concerned Arbitrator but there has been delay.

5. Since the matter was pending before this Court where the reply of the respondents clearly showed that the petitioners can move before the Arbitrator/appropriate authority, in that background, if the petitioners approaches the appropriate authority in next eight weeks, the delay in filing the petition shall be condoned taking into account the aforesaid facts as also that the writ petition was pending till its disposal today.

6. The writ petition stands disposed of with aforesaid observation.
