The petitioners seek bail in anticipation of their arrest in connection with Barhara (Krishnagarh) P.S. Case

Patna High Court CR. MISC. No.1805 of 2021(2) dt.14-07-2021 2/3 No. 302 of 2020, dated 21.07.2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 504, 307 and 379 of the Indian Penal Code.

The accusation against the petitioners is of having assaulted the members of the prosecution party. It has been submitted on behalf of the petitioners that the specific allegation of assault is against Dular Paswan and Ranjan Paswan. So far as the petitioners are concerned, they are only stated to be members of the mob and have not been specifically attributed with any overt act. It has further been submitted that the injuries suffered by the victims are simple in nature.

Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate or concerned Court, Bhojpur at Ara in connection with
