====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2024 At the outset, learned counsel for the petitioners seeks permission to make necessary correction in paragraph Nos. 1 and 10 of the bail application.

2. Permission is granted.

3. Heard learned counsel for the petitioners and the State.

4. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 147, 149, 323, 324, 307, 379, 504, 506 of the Indian Penal Code.

5. As per prosecution case, these petitioners assaulted brother of informant with gadasa and snatched away gold chain and some cash from his pocket.

6. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. Though there is allegation of assault but no injury report is available on the record. Case and counter case. Case lodged by petitioners is earlier in point of time. Petitioners claim clean antecedent.

7. Learned A.P.P. for the State vehemently opposed the bail application.

8. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, East Champaran, Motihari in connection with Kundwa Chainpur P. S. Case No. 166 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
