JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-08-2017 The appellant seeks pre arrest bail in connection with Barhat P.S. Case No. 36 of 2017, registered for offences punishable under Sections 341, 323, 324, 307, 385 and 379 of the Indian Penal Code and section 3(1)(x) of SC/ST Act. Allegation against the appellant is of assault to the informant and demand of rangdari from him.

It has been submitted on behalf of the appellant that he has falsely been implicated in this case and both appellant and informant are tempo driver and in fact the informant fell down from tempo and received some injury and as there was previous dispute between the parties, he has filed this application making such allegations.

Heard learned Special P.P. also.

Patna High Court CR. APP (SJ) No.2484 of 2017 (2) dt.25-08-2017 Considering the facts and circumstances, I am not inclined to grant the appellant, the privilege of pre arrest bail rather appellant surrender before the special court and make prayer for regular bail and if any such application is filed, the special court after considering the submission of learned counsel for the appellant, shall pass an appropriate order, preferably on the same day, without being prejudiced by the order of this Court.
