The petitioner seeks bail in a case registered under Sections 366A, 376/34 of the Indian Penal Code. Allegation is that the accused persons kidnapped the daughter of the informant for illegal purpose. It has been submitted on behalf of the petitioner that the petitioner is in custody since 30.06.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case due to village politics. The victim has been examined by the Medical officer. No sign of rape is said to have been found. Medical evidence does not support the ocular evidence of the victim.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Tr. No.4380 of 2018 arising out of Ram Nagar P.S. case No.267 of 2009.
