JUSTICE SHIVAJI PANDEY ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner and counsel for the State as also counsel for the Corporation. In the present case, the petitioners are employees of the Bihta Sugar Mill, an unit of the Bihar State Sugar Corporation Limited. A claim has been made that the petitioners have been
Patna High Court CWJC No.4564 of 2013 (4) dt.19-02-2016 paid part salary and part gratuity and are claiming for the rest amount of salary and gratuity.
Learned counsel for the petitioners submits that even after the closure of the industry for such a long time earlier, the petitioners have been deprived of the entire salary and gratuity. It is the bounden duty of the Corporation to give rest of the salary and gratuity whereas the learned counsel for the Corporation submits that whatever amount was payable to these petitioners has already been paid to them and nothing remains outstanding against the Sugar Corporation.
Be that as it may, this Court would direct the petitioners to file a fresh representation to the Managing Director of the Corporation who will examine the same and take a decision by passing a reasoned order within a period of six months from the date of filing of the representation along with a copy of this order. With the aforementioned observation and direction, this application is disposed of.
