The petitioners seek bail in a case registered under Sections 467, 468, 471, 420, 414/34 of the Indian Penal Code. Allegation is that one Scorpio vehicle was coming which was stopped by the police and it was found that three persons were sitting in the vehicle and registration number in front and rear side were written by marker pen and one loose number plate was lying inside the vehicle. It is alleged that the vehicle was suspected to be stolen one.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 30.05.2019 and have got no
Patna High Court CR. MISC. No.44057 of 2019(2) dt.17-07-2019 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The documents in respect of the car in question have already been produced and the car is claimed by one Sunil Rai. The car in question is not stolen property. The petitioners have been made accused due to mistake of fact.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. West, Muzaffarpur in connection with Kanti P.S. case No.385 of 2019.
