JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Agamkuan P.S. Case No. 290 of 2016, registered under Sections 419, 420, 408, 467, 468, 471 and 120B of the Indian Penal Code. The accusation is that informant is General Manager of M/S Prema Motor Private Limited engaged in selling and purchasing of the vehicles of Ford Company. In the Company, Kamaljeet Singh, is the Sales Executive whereas Shashi Shekhar and Jashu Kumar were engaged in the Account Section as Kamaljeet Singh and Abhishek Kumar were engaged in Sale Section of the Company. On 10.08.2016, Shashi Shekhar and Jashu Kumar came near the informant and asked to put the signature on the cheque of Rs.5,000/- for handing over to Deonandan Kumar, who had given as advance.

No.38984 of 2017 (4) dt.12-12-2017 Thereafter, informant made enquiry of Sales Department then came to know that Account Section and Sales Section under conspiracy forged quotation was made available to Deonandan Kumar for taking the loan to financial institution without taking any advance showing the receipt of Rs.2,05,251/- Learned counsel for the petitioner submits that, in fact, petitioner is the sales executive and he had no concerned to Account Section providing any receipt in respect of depositing the money to purchase the vehicle. The petitioner being the sales executive has falsely been implicated in this case. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Patna City, in connection with Agamkuan P.S. Case No. 290 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
