The petitioner seeks bail in connection with Pachpakri P.S. Case No. 78 of 2026 instituted for the offence under Sections 191(2)(3), 190, 192, 194(2), 196(2), 132, 115(2), 117(2), 118(1), 109(1), 324(3)(5)(6), 223(B), 79, 351(2), 352 & 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 3 & 4 of the Damage of Property Act.

The prosecution case, in brief, is that during a Kalash Yatra on 04.05.2026 at Bhandar Village, a dispute over the prohibited use of a DJ near a mosque escalated into communal violence, with both groups allegedly indulging in provocative sloganeering, stone-pelting, and rioting. It is further

No.46236 of 2026(2) dt.20-07-2026 2/3 alleged that the rioters attacked police and administrative personnel, damaged public property and nearby houses, causing injuries to several persons, including police officials and the magistrate, before the situation was brought under control with additional police deployment.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.05.2026. Petitioner bears two (2) criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is named in the FIR. Learned counsel for the petitioner submits that as a matter of fact no one has sustained injury. It is submitted that petitioner is not the member of the procession committee. Other co-accused has been granted bail by the Court below itself. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the
Patna High Court CR. MISC. No.46236 of 2026(2) dt.20-07-2026 3/3 petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Pachpakri P.S. Case No. 78 of 2026, subject to the following conditions: (I) One of the bailors shall be own/close member of the family of the petitioner.
(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
