JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 27-09-2019 Let the joint affidavit filed on behalf of the petitioner and the opposite party no.2 be kept on the record. Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the opposite party no.2.
The petitioner apprehends his arrest in connection with Bettiah (T) P.S. Case No.311 of 2018 registered under Sections 498A of the Indian Penal Code besides Sections 3 and 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner and the learned counsel for the opposite party no.2 jointly submit that due to intervention of the well wisher of the petitioner and the opposite
Patna High Court CR. MISC. No.67590 of 2018(9) dt.27-09-2019 2/2 party no.2, the petitioner and the opposite party no.2 have settled their dispute outside the court in terms of the joint affidavit filed on behalf of the petitioner and the opposite party no.2 today. Accordingly, the petitioner will pay Rs.7,00,000/- (Rupees Seven Lacs) to the opposite party no.2 within one year in installments and both will further proceed for divorce on mutual consent in Divorce Case No.196 of 2018 filed by the petitioner against the opposite party no.2, pending in the court of the Principal Judge, Family Court, Bettiah, West Champaran.
Having considered the facts and the circumstances of the case and the above stated submissions of the parties, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah (T) P.S. Case No.311 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S.
