The petitioner seeks bail in connection with Sohsarai P.S. Case No. 28 of 2021 giving rise to Session Trial No. 430 of 2021 instituted for the offences under Section 392 of the Indian Penal Code and charge-sheet has been submitted under Sections 395 and 412 of the I.P.C.

Learned counsel for the petitioner submits that the petitioner is in custody since 28.02.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that the informant alleges that a theft was committed in his house by four unknown criminals of the articles detailed in the F.I.R. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 28.02.2021, charge-sheet has been submitted in the case, his name transpired in the confessional statement of co-accused and nothing was recovered from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IV, Bihar Sharif, Nalanda in connection with Sohsarai P.S. Case No. 28 of 2021, Session Trial No. 430 of 2021 with a condition that one of the bailors shall be the father of the petitioner Nandan Rajak and in the event if the petitioner is implicated in a case of similar nature, the court below shall forthwith cancel his bail bonds.
