2. The petitioners apprehends their arrest in a case registered under Sections 316(5), 318(4) and 61(2) of B.N.S, 2023.

3. As per prosecution case, during course of inquiry, it was found that petitioners received three installments of Rs. 40,000/- each of Pradhan Mantri Awas Yojna (PMAY) on the recommendations of Gram Sabha for making one room along with the earlier house and shown the construction work of another place.

4. Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to village politics. Further submission is that after due verification of construction of the house of the petitioners under PMAY scheme, the said

Patna High Court CR. MISC. No.47935 of 2025(2) dt.04-08-2025 2/2 amount has been released. Petitioners were only the beneficiaries of the Pradhan Mantri Awas Yojna and not the Sanctioning Authority. Similarly situated co-accused, namely, Kiran Devi has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 21.07.2025 passed in Cr. Misc. No. 45991 of 2025.

5. Learned A.P.P. for the State opposed the prayer for bail.

Keeping in view the aforesaid facts and submissions of learned counsel for the parties, let the petitioners be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sheikhpura in connection with Korma P.S Case No. 45 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.
