JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-09-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Motipur P.S. Case no. 112 of 2017, registered under Sections 147, 148, 149, 341, 323, 448, 427, 380, 354, 504 and 506 of the Indian Penal Code.
The accusation is that on 28.04.2017 seven persons named in the F.I.R, including the petitioners, reached at the door of the informant at about 10.30 P.M. boarding on three motorcycles variously armed with lathi, danda and illegal arms and started to abuse him. On raising hulla by the informant her husband and other family members also came out from the house then all the accused caused injury to him and her family members and they also started to damage the house hold articles and also took Rs. 20,000/- and ornaments, which were

No.46556 of 2017 (2) dt.22-09-2017 2/2 kept for marriage purpose and at that time all started to flee away by making firing, but one Sunil Rai was apprehended, who also sustained injury in that course. One cartridge was recovered on the spot. Learned counsel for the petitioners submits that, in fact, due to election rivalry hot talks were exchanged between the parties, but with ulterior motive, the petitioners and other were implicated in this case. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Motipur P.S. Case No. 112 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
