The petitioner seeks bail in connection with Sheohar P. S. Case No.193 of 2021, instituted for the offences under Sections 25(1-B)a, 26, 35 of the Arms Act and Sections 20(B)IIB, 25, 29, 8 of the N.D.P.S. Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 15.06.2021, charge-sheet has been submitted in the case and has antecedent of four cases. The learned counsel for the petitioner submits that the informant alleges that from petitioner, one loaded country-made pistol was recovered and from Rupesh Kumar @ Golu Upadhyay, a country-made loaded pistol along with 2.5 ganja was recovered from a bag which he was carrying.

Patna High Court CR. MISC. No.57662 of 2021(2) dt.03-03-2022 2/2 The learned counsel for the petitioner submits that from perusal of the allegation, it would manifest that as far as this petitioner is concerned, against him the allegation is only of recovery of a loaded country-made pistol.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Sheohar in connection with Sheohar P. S. Case No.193 of 2021, subject to condition that one of the bailors shall be the father of the petitioner namely, Surendra Singh and in the event, if the petitioner is implicated in a case of similar nature, the learned Court below will forthwith cancel his bail bonds if it comes to the notice of the learned Court below.

The application stands allowed.
