JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 05-12-2018 The present writ petition has been filed for a direction to the respondents to issue work order of Tender Inviting Notice vide informtion no. RWD/3054/63/E-Tender/2013-14 for the work of repairing of Road from boundary of Jamalpur Block (Fulka) to boundary of Suryagarha Block (Basauni) Via Dharhara measuring 13 K.M. for an estimated cost of Rs. 155.00 lakhs for which the petitioner has submitted his online tender, he is fulfilling all the criteria as mentioned in the tender notice and he is the single tenderer of the said notice; and for connected reliefs.

2. As none appeared on behalf of the petitioner the

Patna High Court CWJC No.24961 of 2013 dt.05-12-2018 2/2 matter was passed over for a few cases. However, on repeat call the petitioner was again not represented.

3. Learned counsel for the respondents submits that the tender itself has been cancelled in accordance with the powers conferred in terms of Clause 15 of the tender notice as far back in the year 2013 itself, as stated in para 6 of the counter affidavit.

4. Having regard to the stand of the respondents, the writ petition stands dismissed.
