The petitioner apprehends his arrest in Ramgarh P.S. Case No.16 of 2019 registered under Sections 307, 379 and other sections of the Indian Penal Code and under section 3⁄4 of the Prevention of Damage to Public Property Act. It is alleged that the mob of 101 persons named in the F.I.R. including the petitioner and others attacked on the police station. They also burnt the vehicles on account of commission of rape and murder of the victim.
Learned counsel for the petitioner submits that no specific allegation is made against the petitioner. Similarly situated many other accused persons were granted anticipatory bail by different benches of this court in Cr.Misc.No.26917 of 2019, Cr.Misc.No.32928 of 2019, Cr.Misc.No.21142 of 2019
Patna High Court CR. MISC. No.43875 of 2019(2) dt.17-07-2019 2/2 and Cr.Misc.No.24299 of 2019.
Having considered the facts aforesaid and the fact that similarly situated many other accused persons have already been granted anticipatory bail by different benches of this court and the case of the petitioner stands of same footing, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. I, Kaimur at Bhabua in connection with Ramgarh P.S. Case No.16 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
