The petitioner seeks pre-arrest bail in Deep Nagar P.S. Case No.33 of 2011 registered under Sections 392 of I.P.C.. Learned counsel appearing for the petitioners submits that, the petitioner is not named in the F.I.R. rather the name of the petitioner has come in the confessional statement of one Sanjit Kumar and except that there is nothing to show his involvement in this case.
It appears from perusal of the F.I.R. that the informant has detailed the physique of the culprits. As such, I am not inclined to grant the privilege of pre-arrest bail of the petitioner. Accordingly, his prayer for bail is rejected. However, petitioner is directed to surrender before the
Patna High Court Cr.Misc. No.71433 of 2018(4) dt.30-01-2019 2/2 learned court below within a period of four weeks and seek regular bail which shall be considered on its own merit without being prejudiced by this order.
