The petitioner apprehends his arrest in connection with Motihari Mahila P.S. Case No.16 of 2020 registered for offences under Sections 420, 406 and 493/34 of the Indian Penal Code.
It has been jointly submitted by learned counsel for the parties that the dispute between the parties has been settled and the petitioner paid Rs.300000/- (Rupees three lakhs) to opposite party no.2.
Mr. Surya Narayan Yadav, learned cousnel for the
Patna High Court CR. MISC. No.7756 of 2021(3) dt.24-01-2022 2/2 opposite party no.2 submits that his client has received the amount in question.
In view of the aforesaid submission, this application for anticipatory bail is allowed.
Accordingly, let petitioner, above-named, in the event of his arrest or surrender within ten weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Motihari Mahila P.S. Case No.16 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
However, before accepting bail bond of the petitioner, the court below shall call upon the opposite party no.2 and get itself satisfied that the dispute between the parties has been settled.
With the aforesaid observation and direction, this application is allowed.
