JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-08-2024 The present writ petition has been filed seeking the following relief:- "1.That this writ application is being filed for issuance of a direction to Respondents no. 1, 2 and 4 for payment of rent month to month to the petitioner after adding increased rent permissible in the B.B.C. Act, as per rent fixed by Respondent No. 5 in Rent Fixation Case No. 05/2007, vide order dated 17.04.2007, at the rate of Rs.

6,450/-, by fixing rate to the tune of rupees 4/00 per square feet, in view of long gap of fixation of rent by the Respondent No. 5, which was rejected

Patna High Court CWJC No.10883 of 2015(5) dt.21-08-2024 2/2 by the Respondent No. 5 vide order dated 10.12.2014, passed in B.B.C.

Case No. 16 of 2012, after quashing the order dated 10.12.2014 passed by Respondent No. 5. The petitioner further prays to direct the Respondent No. 4 to pay rent at least @ Rs.

15,000/- per month and/or grant any other relief/reliefs, for which the petitioner is found entitled to."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, including that of approaching the learned Court of House Controller-cum-Sub Divisional Magistrate, Biharsharif, District-Nalanda, for redressal of her subsisting grievances. Liberty, so sought, is granted.

The writ petition stands disposed off on the aforesaid terms.
