JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-01-2019 This application, for grant of anticipatory bail, arises out of Khagaria P.S. Case No. 888/17, disclosing offences under Sections 364 of the Indian Penal Code.
Allegation is of kidnapping the brother of informant. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and they are not named in the F.I.R, their name has been surfaced in this case on the third statement of the informant only on the basis of suspicion and considering the same, other co-accused Lodhi Yadav has been granted the privilege of anticipatory bail vide order dated 11.07.2018 passed in Cr. Misc. No. 24751 of 2018.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S.
