The petitioner seeks bail in Masaurhi P.S. Case No. 315 of 2018 (Sessions Trial No. 69 of 2019), instituted for the offence under Section(s) 302 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of learned Additional District & Sessions Judge-IX, Patna. As per written report petitioner fired shot on son of the informant causing injury in his chest and he died on the spot.

Counsel for the petitioner submits that trial is in progress and three witnesses have already been examined. This Court seeing direct allegation against the petitioner of causing firearm injury to the son of the informant,

Patna High Court CR. MISC. No.44330 of 2019(2) dt.24-07-2019 2/2 on account of which, he died on the spot, is not inclined to grant bail the petitioner at this stage.

Prayer for bail of the petitioner stands rejected. The trial court is directed to expedite the trial and make efforts to conclude the trial as early as possible preferably within a period of nine months from the date of receipt of this order.

Petitioner will be at liberty to renew his prayer for bail after nine months in the event the trial is not concluded within aforesaid period.
