In this case, the petitioner is seeking anticipatory bail in connection with Fatuha P.S. Case No.0202 of 2017, registered for the offence punishable under Section 7 of the Essential Commodities Act.

Allegation has been made against the petitioner that from his godown 170 bags of wheat of Food Corporation of India were recovered.

Learned counsel for the petitioner submits that the petitioner is a dealer and the wheat which was recovered belonged to him.

Patna High Court Cr.Misc. No.40774 of 2017 (2) dt.21-09-2017 2/2 Looking to the facts and circumstances of the case, let the petitioner, namely, Sanjay Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Patna City, Patna, in connection with Fatuha P.S. Case No.0202 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
